Cannabis Possession Limits in New Jersey

New Jersey has some of the most generous possession limits in the country — up to 6 ounces of flower. Here's exactly what you can legally possess and purchase.

Personal Possession Limits

Under the CREAMM Act and related decriminalization legislation, adults 21 and older in New Jersey may legally possess the following amounts of cannabis:

Product Type Possession Limit Notes
Cannabis Flower 6 ounces (170 grams) Personal possession, any combination of strains
Hashish / Concentrates 17 grams Includes wax, shatter, oil, and other concentrates

New Jersey's 6-ounce possession limit is notably one of the highest in the United States among legal cannabis states. For comparison, most states set the limit at 1 to 2.5 ounces. This generous limit was established through the decriminalization legislation that accompanied the CREAMM Act.

No person may be arrested, prosecuted, or penalized in any manner for the personal possession of up to six ounces of cannabis or 17 grams of hashish.

Per-Transaction Purchase Limits

While you can possess up to 6 ounces, the amount you can purchase in a single transaction is more limited. This is an important distinction in New Jersey law:

Product Type Recreational (per transaction) Medical (per 30 days)
Cannabis Flower 1 ounce (28.35g) 3 ounces (84g)
Solid Concentrates 4 grams Included in 3 oz allotment
Edibles 10 packages (1,000mg THC total) Included in 3 oz allotment
Possession Limit 6 ounces (170g) flower or 17g hashish/concentrates

Understanding the Difference

New Jersey's cannabis law creates a two-tier system:

  • Possession limit (6 oz): The maximum amount of cannabis flower you can legally have on your person or in your home at any time.
  • Transaction limit (1 oz recreational): The maximum amount you can purchase in a single dispensary visit.

This means you can accumulate up to 6 ounces through multiple purchases over time, but you cannot buy more than 1 ounce in any single transaction. There is no daily purchase cap restricting you from visiting multiple dispensaries in the same day.

Medical Patient Allotments

Medical cannabis patients operate under a different system:

  • 3 ounces per 30-day period is the standard medical allotment
  • Your physician may set a lower allotment based on your specific condition and treatment plan
  • The CRC tracks medical allotments through the state's seed-to-sale tracking system
  • Medical patients are also subject to the 6-ounce personal possession limit

The 3-ounce monthly allotment for medical patients is substantially more than the 1-ounce per-transaction limit for recreational customers, providing patients with greater access to their medicine.

Equivalency: How Products Convert

Not all cannabis products are measured the same way. The CRC uses equivalency formulas to convert between different product types when calculating purchase limits:

Product Type Equivalent to 1 oz Flower
Dried Flower 28.35 grams (1 ounce)
Solid Concentrates (wax, shatter) Approximately 4 grams
Infused Edible Products 10 packages (up to 100mg THC each)
Liquid Concentrates (vape oil) 4 cartridges (varies by volume)

When you purchase a mix of product types, the dispensary calculates your total using these equivalencies to ensure you stay within your per-transaction limit.

Edible Limits

New Jersey regulates edible cannabis products with packaging and dosage requirements:

  • 100 mg of THC per package (maximum)
  • 10 mg of THC per serving (per individual piece or unit)
  • All edible products must be lab-tested and properly labeled with THC content per serving
  • Child-resistant packaging is mandatory

Under the per-transaction limit, recreational customers can purchase up to 10 packages of edibles (1,000 mg total THC) in a single transaction.

What Happens If You Exceed the Possession Limit?

Possessing more than 6 ounces of cannabis flower or more than 17 grams of hashish/concentrates is a criminal offense in New Jersey:

Amount Over Limit Classification Potential Penalty
More than 6 oz flower Fourth-degree crime Up to 18 months prison, up to $10,000 fine
More than 17g hashish/concentrates Fourth-degree crime Up to 18 months prison, up to $10,000 fine
Significantly exceeding limits (distribution quantity) Third-degree or higher Escalating penalties, potential presumption of intent to distribute

Home Growing: Completely Prohibited

No Home Cultivation

New Jersey does not allow any home growing of cannabis, even for personal use. Growing cannabis without a CRC license is a third-degree crime carrying up to 5 years in prison and a $25,000 fine. This is one of the strictest prohibitions among legal states.

Storage and Transport

When transporting cannabis in New Jersey:

  • Keep cannabis in its original sealed packaging from the dispensary whenever possible
  • Store in the trunk or a locked glove box when driving
  • Do not open or consume cannabis products in a vehicle
  • Never cross state lines — transporting cannabis across state borders is a federal crime, even between NJ and legal states like New York
